SmashPoints respects the intellectual property rights of others and expects users of the platform to do the same. This DMCA Policy describes how copyright infringement claims may be submitted and handled.
1. Filing a Copyright Complaint
If you believe that content available on SmashPoints infringes your copyright, you may submit a notice containing:
- your full legal name and contact information
- identification of the copyrighted work claimed to be infringed
- identification of the allegedly infringing material and its location on the platform
- a statement that you have a good-faith belief that the use is unauthorized
- a statement that the information in the notice is accurate
- a statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
- your physical or electronic signature

3. Our Response
Upon receipt of a valid notice, SmashPoints may:
- remove or disable access to the allegedly infringing material
- notify the affected user
- request additional information
- take further action where appropriate, including account restriction or termination
4. Counter-Notification
If you believe content was removed or disabled by mistake or misidentification, you may submit a counter-notification containing:
- your name, address, telephone number, and email
- identification of the removed material and its prior location
- a statement under penalty of perjury that you have a good-faith belief the material was removed in error
- a statement consenting to the jurisdiction of the appropriate court
- your physical or electronic signature
5. Repeat Infringers
SmashPoints may suspend or terminate accounts of repeat infringers where appropriate.
6. Misrepresentation
Any person who knowingly submits false claims or misrepresentations may be subject to liability under applicable law.
